1. Business Identity

Tech Quest Web Solutions Inc., operating as TQWS Inc., provides web development, digital marketing and business technology consulting services.

These Terms of Service govern both use of this website and paid services purchased from TQWS Inc.

2. Written Scope

Each paid engagement is governed by a quotation, invoice, proposal or service agreement describing the work, price, currency, delivery method and expected timeframe.

3. Customer Approval

Work begins only after the customer accepts the written scope and applicable terms. No paid work is started, and no payment is requested, before that approval.

4. Payment Authorisation

The payer must be the cardholder or must have authorisation from the cardholder. TQWS Inc. may request reasonable identity or payment verification for unusual or higher-value transactions.

Card payments appear on the customer’s statement as TQWSINC.COM. See the Payment Methods page for accepted payment methods and currency information.

5. Scope Changes

Work outside the agreed scope requires written customer approval and may require a separate quotation. No additional work or charge is applied without that approval.

6. Customer Responsibilities

Customers must:

• Provide accurate information
• Own or be authorised to use the website, account, system or device involved
• Maintain backups of important information
• Maintain valid software licences
• Provide necessary approvals
• Review the completed work
• Report material concerns promptly

7. Service Delivery

Services are delivered according to the written quotation, invoice or agreement. The applicable delivery method and timeframe will be communicated before payment. Further detail is set out in the Service Delivery Policy.

8. Third-Party Services

Domain registrations, hosting, advertising spend, software subscriptions, licences, hardware and other third-party costs are not included unless specifically listed in writing.

Our services may reference or connect to third-party websites, platforms and services that are not owned or controlled by TQWS Inc. We are not responsible for the content, policies or practices of those third parties.

9. Business Technology Limitations

Outcomes may depend on device condition, software compatibility, internet or network availability and third-party platforms. TQWS Inc. does not guarantee that every technology issue can be resolved.

Hardware replacement, physical repair, manufacturer warranty service and third-party licence costs are not included unless specifically listed in the written quotation. Where an issue requires a manufacturer, internet provider, software publisher or repair centre, we will explain this to the customer.

10. Independent Provider Disclosure

TQWS Inc. is an independent web development and business technology consulting company. Unless expressly stated in writing, TQWS Inc. is not affiliated with, sponsored by, endorsed by or authorised by any software, computer, printer, hosting or technology manufacturer. All third-party product and company names belong to their respective owners.

11. Refunds and Cancellations

Refund and cancellation terms are set out in full in the Refund and Cancellation Policy, which forms part of these Terms.

12. Intellectual Property

This website and its original content, features and functionality remain the property of Tech Quest Web Solutions Inc. and its licensors, and are protected by copyright, trademark and other applicable laws. Ownership of work produced for a customer is addressed in the applicable quotation or service agreement.

13. Acceptable Use of This Website

You agree to use this website for lawful purposes only. You must not use it in any way that would constitute an illegal offence, give rise to liability, or otherwise violate any applicable local, provincial, state, national or international law or regulation.

14. Disclaimer and Limitation of Liability

This website is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the extent permitted by applicable law.

To the extent permitted by applicable law, Tech Quest Web Solutions Inc. and its directors, employees, partners, agents and suppliers will not be liable for any indirect, incidental, special or consequential damages arising from use of this website. Nothing in this section limits liability that cannot be limited under applicable law.

15. Consumer Rights

Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer-protection laws.

16. Governing Law

These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada, without regard to conflict of law provisions.

17. Changes to These Terms

We may modify these Terms from time to time. Where a change is material, we will take reasonable steps to provide advance notice. The quotation or service agreement in effect when you approved your project continues to govern that engagement.
